Question

Amending dependence on taxes

I have an agreement with my son's mother that she will be claiming him as a dependant this year.   However after I filed my own taxes, I noticed that it has my son listed as one of my dependence so now she is not able to claim him or receive any child tax credit.

My question is can she still claim him if she files on paper and sends it in the mail while my taxes are being amended to take him off as a dependent?

Your plan to amend your return and have her mail hers with an explanation that you have amended your return is correct. However both your amended return and her mailed return might take many months to process.

Thank you for replying.  What do you mean by providing an explanation? Will the IRS pay her fully and then just send me a notice that I will have to pay back money for claiming him originally? Or is there a step I am missing?
