Can my husband file for an amendment on his return? Before we got married I had debt and now that we are married the us department of education is taking both of our refunds for only my tax debt.

Yes, your husband can amend his return from Married filing jointly to Married Filing Separately.

You have to file both of your separate returns before April 15th..

The one who is listed first will amend the return to Married filing separate and remove the spouse's income and deductions.
