my brother in law passed away in 2015 and my husband inherited the property. We have been paying the loan from our own money and have legal documents stating he is the owner now but it isn't in our name,still in the deceased name. Can we claim the interest and taxes on our taxes?"

Yes, if your husband has an interest in the property (per your legal documents) and actually paid the mortgage and property taxes, he can claim mortgage interest and property taxes on his tax return.

He can only claim mortgage interest on two homes: his residence and a second home. And I assume that the inherited property is a second home.

In entering mortgage interest, please make sure to answer the questionnaire carefully if the form 1098 is not in his name.
