I am a WA state resident and received a 592-B.

What do I do with this form? Since I am not a California resident, do I need to put this on my tax return and if so, where?

    Apparently there is some CA income and withholding for tax year 2023.  Depending on the source of the income you may have a CA filing requirement.  You will claim the credit for the withholding on whichever CA tax return form you file.  Below is a list of potential CA forms to claim the withholding credit again depending on the source of the income.

     

    NOTE:  If you received some other income form (1099 or K-1 for example) that shows the income and CA withholding already you do not need to re-enter the information from the form 592-B into your CA return; you can ignore it. 

     

    • Form 540, California Resident Income Tax Return
    • Form 540NR, California Nonresident or Part-Year Resident Income Tax Return 
    • Form 541, California Fiduciary Income Tax Return 
    • Form 100, California Corporation Franchise or Income Tax Return 
    • Form 100S, California S Corporation Franchise or Income Tax Return 
    • Form 100W, California Corporation Franchise or Income Tax Return – Water’sEdge Filers 
    • Form 109, California Exempt Organization Business Income Tax Return 
    • Form 565, Partnership Return of Income 
    • Form 568, Limited Liability Company Return of Income

    Thank you. In the past, I have always received a K-1 from this company (I am a shareholder in a small business that was sold in 2023).   After I contacted you on this site and before receiving your reply, I ended up speaking with a Turbotax agent on the phone who instructed me to go to the State tax portion of my tax form and download "California" in order to enter the 592-B tax info and fill out as a non-resident.  I went ahead and did that, but now I have just been informed that a K-1 is still coming from this company after all, so I am confused about which one to use on my tax form and why would I receive both from them if I only need one for my taxes?

    Getting both makes sense. The k-1 is a federal tax form with much information. The 592-B is a CA form that shows the CA amount subject to withholding/ tax withheld. The k-1 is the primary form  and must be entered. You may not need the 592-B. If used, it would be for a CA adjustment.

    Thank you for your help! I am still struggling though with trying to figure out if I should include both the K-1 and 592-B in my return.  It is the Final K-1 for this company as it was sold last year.  The forms appear to show different numbers as though they weren't even connected to each other, but they are from the same company that I always get just a K-1 from. If I include the 592-B (I tried it) I get an extra refund of $213 and do not get an error code, but I have since deleted this form because I was afraid of getting an extra refund if it is because I submitted both forms and shouldn't have.
