I filed for stimulus and later found out my ex didnt claim kids. Can i claim them for stimulus?

    Yes, if you are eligible to claim your children then you should include them on your tax return. The intent is that stimulus payments are made for each child once so if they were claimed by your ex in 2019, a payment may have already been made for them.  The IRS doesn't seem to have specific information about how to deal with this for 2020.   That being said you should list only payments you did receive yourself on your own tax return and your children as dependents if you qualify.

     

    The rules for claiming a dependent are relevant. This is not a choice or optional but rather a rule on who has the right to claim a dependent.  A dependent of another taxpayer is not allowed a stimulus payment, meaning that if your children should need to file a tax return they must indicate they are being claimed.

     

    If you are eligible to claim your children as  dependents, they can provide additional stimulus amounts.  The rules for a qualifying child are shown for your convenience.

     

    Qualifying child

    • They're related to you.
    • They aren't claimed as a dependent by someone else.
    • They're a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.
    • They aren’t filing a joint return with their spouse.
    • They're under the age of 19 (or 24 for full-time students).
      • No age limit for permanently and totally disabled children.
    • They lived with you for more than half the year (exceptions apply where divorced or separated taxpayers can waive the dependent to the noncustodial parent).
    • They didn't provide more than half of their own support for the year.

     

    File a tax return with the new Recovery Rebate Credit Worksheet. This will allow you to reconcile your stimulus payments and receive any additional payment (refund).

     

    IRS Recovery Rebate Credit

    • In TurboTax Online once your return is open, select Wages & Income (to enter the tax return).
    • Select Federal Review at the top of the page > Continue to answer the questions for Let's make sure you got the right stimulus amount
    • TurboTax will then include any stimulus amount due on your 1040 form - either added to your refund or reduce the amount due.
