I need to amend my return and change HOH. How long does my spouse have to wait if she's claiming HOH?

Please explain further.   Are you and your spouse living apart?  How long have you lived apart?  Who are the children with?   Did you e-file already?  What filing status did you use?

We live together. Mine filed as single HOH claiming our son.  I meant to have her claim him and be the HOH

If all of you live together as a family but are not legally married, then only one of you should have the child entered on a tax return.   The other parent should have filed as Single and not entered anything at all on their tax return about the child.

 

Since you have already filed and used the child's SSN, the other parent who wants to claim the child will be blocked from e-filing this year.   Her return can only be filed by mail   You can amend your own return to remove the child from My Info, but she does not need to wait for you to amend.  She will not be able to e-file this year, even if you amend.

 

It is better for the parent with the higher income to file HOH and claim the child.   Which of you had the higher income?
