I owe back child support but do not work. Will they take my wifes tax refund even if I haven't worked?

    Yes, the refund from your joint tax return can be seized for your debts.  However, a Form 8379 Injured Spouse Allocation can be filed to prevent your spouse's portion of the refund from being seized.

    So once she files the 8379 will she be able to get what was taken from her back or will the irs still deem part of the return mine even though I did not work all year? I have not ever worked and am currently on ssi disabilty.
