Question

I qualified for the American rescue plan $10,200 deduction of unemployment but I still have not received my refund.

I paid $532 in unemployment tax in 2020 and I paid it before the plan went into affect. Should I amend my 2020 taxes or continue to wait to for a check in the mail or DD?

There are still people waiting for this to be corrected by the IRS   however are you sure you are due more a refund ?   Did you ever get the original refund ? 

 

You will get an additional federal income tax refund for the unemployment exclusion if all of the following are true.

 

  • You reported unemployment benefits as income on your 2020 tax return, on Schedule 1 line 7.
  • You did not get the unemployment exclusion on the 2020 tax return that you filed. The unemployment exclusion would appear as a negative amount on Schedule 1 line 8, with the abbreviation UCE on the dotted line to the left of the amount.
  • Your tax on Form 1040 line 16 is not zero.
  • Your Adjusted Gross Income (AGI), not including unemployment, is less than $150,000.

TurboTax cannot track or predict when it will be sent.  The IRS has not provided a way for you to track it, so all you can do is wait for the refund to arrive.

from what I understood I am owed a refund since I met all the criteria and I paid the tax before the plan was in place. I was just surprised I didn't receive it yet since other family members of mine have received their refund during the summer '21.

Look at the form 1040 you filed   ... what is on lines 24, 33 & 34 ?  If line 24 is a zero then the withholding on line 33 was already on line 34 so there is no more for you to get.    If line 24 is not a zero then the IRS should adjust the return automatically eventually.

You should not have to file an amended return to correct the taxation of your unemployment income on your 2020 tax return. At the same time, according to IRS statements on the subject, it won't delay your refund if you do file an amended return.
