Question

I received a 1099 misc for PFL (maternity leave). Now I am amending my return to include the form. It states that taxes are due, is this correct?

Paid family leave is usually taxable at the federal level and in some states.  You can check with your employer to see if they already added the PFL to your W-2 and taxed you on it already.

If the income has not been taxed then you will enter it as Other Common Income following these steps.  This will report the 1099-MISC and apply the taxes owed.

  • Federal
  • Wages and Income
  • Other Common Income
  • For 1099-MISC
  • Fill in the form
  • Describe the reason for the form as Paid Family Leave
  • It is not work like your regular job and not an intent to earn money

Here are the steps to follow if remove the taxes if you learn from your employer that the money is not taxable or that you have already paid taxes on it:

  • Federal
  • Wages and Income
  • Other Common Income
  • For 1099-MISC
  • Fill in the form but put a minus sign in front of the amount in Box 3 to make it a negative number
  • Describe the reason for the form as Paid Family Leave to remove taxes
  • It is not work like your regular job and not an intent to earn money

Be sure to ask your employer so you do not end up being doubled taxes on the money.
