Question

My dependents are filed by my spouse on the federal tax and state tax, can I claim my dependent on state tax?

My spouse and I are married but filing separately. He claimed our dependents on his federal and state tax return. While I use the Turbotax online filing system, it pointed to me that even your dependents not on your federal tax return, you can still claim them on your state return for California. I proceeded with that option and filed my dependents on my CA tax filing. Is this correct? What should I do if it is incorrect?

No, it is not The option to claim the dependents on your California tax return is not for this situation.

The 2020 FTB Form 540 Instructions for Line 10 state that the persons you list as dependents must be the same persons listed on your federal income tax return unless using Form FTB 3568 when the dependent does not have a social security number or ITIN.
