My parents claimed me as a dependent event though I don't live with them, is it worth it to make them amend their return to get the stimulus?

Hello,

 

My parents claimed me on their 2020 tax return as a dependent, even though I don't live with them and they don't provide any of my living expenses. I've asked them to amend so that I might be able to get some stimulus money, but they are making a fuss and demanding I pay them to do so. I haven't yet filed my taxes. Is it really worth going through the trouble? Will I even get any stimulus payment? From my knowledge they didn't qualify to receive any stimulus from my dependent status. Thanks.

The best thing to do would be to have them amend their return and then wait a month or two before you file your return. If they do that, however, they may have to pay back the stimulus money they already received. You should get your stimulus money if you do that though.

 

You also have to keep in mind that your parents may be getting a tax credit for claiming you as their dependent so they may have to pay some money back for that as well. Also, they have filed a fraudulent return if they claimed you, knowing that they were not entitled to do that.

 

You could file your return and not indicate that you are their dependent and the IRS will investigate and maybe correct things down the road if you protest enough.

You don't have to wait and you don't have to have your parents amend their return (although it helps).

Your return will be processed as received.

When IRS sees a conflict they will take steps to determine who filed correctly and who did not.

That determination could take a long time.
