My tax return has been offset due to husband's state offset, the income filed is only mine. when I amend do I file an injured spouse or change to married filing seperate

Our return has been approved, but the tax offset is taking the entire tax return. The debt is not mine and the income on the return is all mine.

    You can file an injured spouse form to protect the part of the refund that can be attributed to your income.   It can be mailed and will take several months to be processed.
