Okay, I feel like I really screwed up here but I need some advice. Me and my ex have an agreement by the courts that he claims child through odd years and I will claim them through even. For 2021 it's his year the claim child, as I was doing my taxes it showed her as EIC / dependent care only. The daycare provided me their tax document with all of my kids on it including child in question. They all attend the same day care and I am the one who pays all of the child care fees. When I added that into my taxes when I was filing that's when the eic/dependent care only was placed on child name. I was reading other questions similar towards mine and they say that he should have no problem claiming them. But I needed to ask for myself.

If you are the custodial parent only you can claim eic and child care credit and file as head of household if otherwise eligible. That is true even if you give him permission to claim the dependency which you should do by giving him a signed form 8332.
