Prior year tax amend MFS to MFJ with new ITIN

Hello All,

I got married in Mid 2022 and my wife joined me here in the US on F1 Visa in 2022 only, while filing taxes in year 2023, I filed as MFS(Married filing separately) as she did not had any SSN/ITIN.

This year in 2024 I filed my taxes as MFJ and also applied for my wife's ITIN, which we received recently.

My question here is, Can we amend the prior year tax return filing year 2023 to change the status from MFS to MFJ with her ITIN ?

Generally, yes, you can amend to file jointly now that you have an ITIN for your spouse.  

If certain credits are on the amended tax return, they may be disallowed by reason of the ITIN not being issued before the tax filing deadline but other changes are generally accepted by the IRS.

You'd be no worse off if they reject the amendment (or simply disallow credits) than you are now, so I would encourage amending the return.
