To clarify, can you provide more details?

    • Was there a final return filed for the estate.
    • You mention dad's estate interest. Does this mean he was a beneficiary of an estate or was this actually his own estate.
    • You mention file his taxes this year. is he alive or deceased. If deceased, what was this date of death?

If the estate was in his name and he is deceased, here are some things to keep in mind.

    1. Final Tax Return: If your father did not file a final tax return for the year of his death, you or the appointed representative should file it. This return should include all income up to the date of death.
    2. Claiming the Refund: To claim the refund, you will need to file Form 1310, Statement of Person Claiming Refund Due a Deceased Taxpayer. This form is used to claim a refund on behalf of a deceased person.
    3. Your Taxes: If the estate has been settled and the refund was distributed to you, you should report it on your personal tax return for the year you received it.
