Question

Can I use Schedule C for an LLC that I share with my wife? We are filing jointly. Should I fill out 2 Schedules C, one for each of us?

We started the LLC this year (real estate focused), but did not have revenue.
My wife was not active in the LLC.

If you live in one of the community property states: Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, or Wisconsin, then you can elect for your "husband and wife" LLC to be treated as a single-member LLC, and thus, report the income and expenses on your individual tax return. And if it is a non-rental activity, then yes, you would report it on each of your separate Schedule C's. Doing that will constitute an election. Usually, the split of income and expenses between spouses is based on the percentage of ownership.

However, if you are not a resident of one of those states, then you must file Form 1065, a partnership return (unless you made a separate election to be treated as a corporation). That partnership tax return will generate Schedule K-1s for each of you, and you will report that information on your individual tax return.
