Is legally acquired topical CBD, used for arthritis pain, deductible?

Over the counter medications do not qualify, even if they are prescribed.  You would have to obtain the items from a licensed pharmacy.

 

Separately, marijuana is still illegal under federal law, and the IRS is controlled by federal law.  No tax deduction is allowed for prescriptions or procedures that are illegal under federal law.  Whether CBD is illegal under federal law seems to be a complicated question that I don't have time to research.  Here is an article that might be helpful.
