If I cosigned for a student loan while my child was my dependent and paid the loan off after he was no longer a dependent but still a full time student in grad school and not working. Can I claim the 1098-E interest. My child didn't have any earned income so it won't do him any good to claim the interest paid.

Did you pay the interest in 2019?  As long as you pay, you can claim.

You can claim if you have met two of the following requirements in:

  • You paid interest on a qualified student loan in the tax year 2019;
  • You're legally obligated to pay interest on a qualified student loan;
  • Your filing status isn't married filing separately;
  • Your MAGI is less than a specified amount which is set annually; and
  • You or your spouse, if filing jointly, can't be claimed as dependents on someone else's return.
