Can I claim my son even if his mother received the early child tax payment

even if I say that I have received the early payment just to receive the rest of the child tax credit

If the other parent received the advance CTC payments you do NOT say that you received the payments.   If you are the one claiming the child on your own 2021 tax return then you are eligible for the full amount of the child tax credit.   His mother has to file a tax return and enter the amount SHE received.   Depending on how much her 2021 income was, she may or may not have to pay it back.   What happens with her advance payments is not your concern and does not go on your tax return.

 

Your child tax credit will show up on line 28 of your Form 1040.

Yes, you can claim your son even if his mother received the Advance Payments.  When you are asked if you received any advance payments, you will answer no, if you yourself did not receive them. You will receive the full credit if you and your son both qualify.

 

 If his mom received the Advanced Payment, depending on her income she may or may not have to repay it if she is not claiming him on her return this year.
