Can I deduct a parent of whom I am legal guardian?

I pay all of his bills. He is in a memory care facility

Are you the one who is paying for the nursing home----not Social Security, Medicare or Medicaid?    If you are the one who is paying for your parent's care then you can list your parent as a dependent on your tax return and enter the costs of the care under your medical deduction if you are itemizing.  The nursing home should be able to provide a breakdown of the "medical" parts of their fees  (which will not include certain services provided there)  for use on your tax return.

Yes, if you are paying all of his bills and more than half of his support, and he does not have income other than Social Security of more than $4,300, then you can claim him as a dependent even if he is in a memory care facility.
