Can I deduct legal fees for settling my deceased brother's estate?

If you paid the legal fees personally, the estate should reimburse you for those fees.

 

The estate can deduct the legal fees incurred on its tax return (1041 or 706).

The legal fees associated with the estate are deductible by the estate. If you are preparing a Form 1041 for the estate, the deduction would be entered there.
