Can I deduct legal fees related to probating my mother's estate?

I paid my attorney nearly $18,000 for probating my mother's estate. This was paid out of an estate account that I am the administrator of and will be inheriting after final distribution of all estate assets.

The estate can deduct probate fees, not the administrator.

 

IRS says: “You may deduct expenses incurred in administering property that is included in the gross estate but that is not subject to claims.”
