Question

Can I qualify for the EIC in my state of residence if I work in another?

I’m filing in both states and all of my income is in my non-resident state. I didn’t qualify for the federal EIC but shouldn’t I qualify for my resident state since my taxable income is zero?

The requirements for EIC vary from state to state, but generally you won't qualify for the state credit if you have no earned income in that state.  Please clarify so that we can answer your question:

    • What state did you live in?  Did you live there the full year?  If not, what were your residency dates?  Did you have any earned income (i.e., wages, self-employment) there?
    • What state did you work in?  Did you live there at all during the year?
