My son received Child Care Tax Credit and Other Tax Payments in 2021. He has no income.  I supported him and my grandson.  I can claim them both as dependents.  does my son need to file a separate tax return?

    You mean he received the advance child tax credit payments.   Yes, your son must file a tax return to report the child tax credit payments he received between July and December.   If he had no other income in 2021 he will not have to pay it back.  He should have letter 6419 from the IRS which he is required to enter on a tax return.

     

    Meanwhile if you are the one claiming your son and your grandchild on your own 2021 tax return, you can get the full amount of the child tax credit for the child.  The amount you get is not affected by the payments your son received.
