What happens if the unentitled ex-spouse takes the monthly tax credit money when it is the other parents yiear to claim the child.  Will he only get the remaining half or will she have to pay back the money she was not entitled to?

    Base facts ... the person claiming the child  on the 2021 return  gets the entire credit less what they personally  got in advance (what the other parent got is immaterial).

     

    If you got the advance but are NOT claiming the child on the 2021 return you will have to payback some or all of the advance payments.

    Hi Spealer,

     

    There is a process that the IRS will use to determine the amount of Child Tax Credit that a taxpayer receives. The person receiving the Advanced credit will receive a 6419 Letter from the IRS that details the amount of credit that was received. The person receiving that letter will have to include the pertinent information on their tax return. Since the Child Tax Credit follows the child, It will depend on the tax return that has the child's information that will receive the credit next year. If the child is not on the other's tax return in 2021, there will be no tax credit given and there will be a reconciling of the credit received as an advance in the previous year.

    That did not answer my question.  My son will be claiming his son on 2021 return. His ex collected the money since July because she claimed him last year.  Will my son get the full tax credit for 2021 or not is my question..
