Can my ex-boyfriend claim Childcare Tax Credit for my non-joint daughter? We split  50/50 childcare expenses until September 2022. I claim her on my taxes as I have always had sole custody of her. If he can't, what happens to remaining amount of money paid to childcare that I can't claim since it was not my portion of it?

No, the custodial parent is the only one who can claim expenses that were paid for child care using the Child and Dependent Care Credit. You are the custodial parent and can only claim money you paid for child care. Any monies anyone else paid would not be eligible for the credit.

Only one person can claim a child as a dependent, and only that person can claim the dependent care credit.  Your boyfriend can't claim a child who is not his biological child unless the child lived in his home the entire year and there is no parent who can claim the child.  It sounds like your ex fails both those tests.

 

You claim the credit based on what you paid for care, if the reason you paid for care was so you could work or go to school.   No one gets to claim any tax credits for the parts of the care expense that you did not pay.
