Claiming grandchildren

My daughter and two grandsons have resided with me for the past 6 years.  She has another baby on the way.  She has recently moved out.  Since they have lived with me for 7 months and I paid rent, power, water, etc. - Am I able to claim them as dependents for 2024?

In the case of a grandparent claiming the claiming a child 

  • A non-parent, if no parent claims the child as a qualifying child although he or she may do so and only if the non-parent's AGI is higher than the highest AGI of any parent who may claim the child, 
  • If the babies parent can claim she has first rights. If the parent is also your dependent you may claim them both. Your child if over the age of 19 and not a full time student cannot make more than $4700 in 2023 .
  • If your daughter has no obligation to file a tax return and does not do so you can claim the grandchildren
