my girlfriend has live with me for 3 years.

in 2020 she went to rehab in CA for 6 months. she got a job there and earned $4301. 

she has been back living with me since july with no income. 

can I claim her as a dependent? 

The rules state that rehab qualifies as a valid reason why she didn't didn't reside here all year, and that her total income can't exceed $4300.

i hope that her being over the income limit by $1.00 isn't going to be a problem.

     Your GF did not live with you all year.   That "temporary absence" rule applies to children--such as college students who live away at school.   You cannot claim your GF for 2020 since she did not live with you the whole year----and she earned more than the $4300 limit.   She can file her own tax return and seek the recovery rebate credit for stimulus payments #1 and #2 on her own 2020 return, and then she should also qualify for the 3rd check of $1400 later on.  You, on the other hand, cannot receive stimulus checks 1 or 2 for claiming her----all you miss out on is a $500 credit for other dependents and you do not the the $1400---she gets it.
