Dependent Care FSA: Reimbursement for 5 Year Old in Preschool

Investopedia.com says that "The FSA can also cover preschool tuition and summer camps, although you can’t use the account to pay for kindergarten or school tuition for a child ages five and older."

 

My 5 year old son has a November birthday, so he missed the cut off to begin kindergarten with his friends and is currently in preschool. The Dependent Care FSA allows reimbursement for preschool tuition but he is also 5 years old. 

 

Is the ability to get preschool reimbursed driven by the the education level being provided (i.e. preschool) or age?

Care is eligible if it is provided so you can work or look for work or attend school full time yourself.  It doesn't matter if the care includes education (like pre-school).  Age is not the determinant, enrollment is.  If your child is not yet enrolled in kindergarten, then the pre-school is eligible if you are paying for care so you (and your spouse if married) can work.
