My boyfriend and I have been living together for the past 6 months.   I had a son on December 8th and we thought my boyfriend was the father.  I have since found out that he isn't his biological father but has provided most of the support for my son and me.

 

Can he claim my son on his taxes?

If you did not earn more than $4,200 he can claim you and the child.  If you earned more than that he cannot claim you.  If you earned more than that but less than $12,200 and you don’t have a requirement to file a return, he can claim the child but not you. If you do have a filing requirement only you can claim the child.
