Earned Income Credit

My return was rejected because my sons father is claiming our son this year and I am claiming daycare expenses and TurboTax keeps trying to make me take the Earned Income Credit and I cannot claim this because my sons father already claimed this.  I do not know how to fix this in the program.

Your son is either a dependent for you or for the child's father. 

If you are divorced, either you, or the father is the custodial parent. (the parent the child lives with for more than half the year) 

The custodial parent can sign Form 8332 and allow the non-custodial parent to claim the child's exemption (which this year is zero) and the Child Tax Credit. 

The Earned Income Credit, the Child and Dependent Care Credit and Head of Household can ONLY be claimed by the custodial parent. 

That is the only way a child can be part of both parent's separate returns.

If the child lives with you, only you can claim the earned income credit and child care credit even though the other parent claims the dependency.
