Question

Earned Income Credit-Turbo Tax asks "Did you and your spouse share the same main residence from July 2022 through December 2022?" I was not married until October 31. No?

Can I answer no? Am I eligible for the Earned Income Credit, as I was not married for most of the year?

Answer the question as it applies to your situation, no if she did not live with you during that time. Depending on filing status it may ask different questions, but as long as you were married as of December 31, 2022 you can claim Married Filling Jointly. Then the income test for the EITC. You don't qualify for EITC without a qualifying child unless you, or your spouse if filing a joint return, are between age 25 and 64.

 

Lastly, some of these questions could be based on the state you live in. If you use one of the filing statuses above and have qualified income under the amount for Married Filing Jointly or depedning on your status you should qualify if you meet the rules.
