EITC and Unemployment Income

It was just brought to my attention that, even though UI is calculated into your AGI, the EITC is based only on earned income. Last year my only income was UI and my spouse made less than $10k in earned income. The year before, in 2020, I earned $4k outside of UI income. Is it possible and advantageous to include that in my 2021 return? I read somewhere if you made more in 2020, you could claim that income for this year. Also, does it complicate things if we weren't married in 2020? Not sure if it helps, but he earned no income that year.

If I can claim my 2020 income, how do I go about this? Thank you in advance.

You raise 2 issues. 
1.  Unemployment income is included in your AGI and your AGI is taken into account in the calculation of EIC along with your earned income. 

2.  If your earned income in 2019 was greater than your earned income in 2021 you can use the 2019 earned income amount if it benefits you.

In 2019, I made 22693 (current spouse made 0). During that year, since I filed single, I didn't qualify for the EIC. If I used my 2019 income for this year, is my qualification based upon the updated 2021's AGI max? And specifically for the jointly married ($27,380), even though we weren't married in 2019?

If you use your 2019 earned income your current AGI will apply.
