If your name is on the mortgage loan then you can take the mortgage interest deduction.  In order to take the Mortgage Interest Deduction, you must be the primary borrower on the loan.  If you and your spouse are both on the loan, then you are still the primary borrower.  If this is the case all you will need to do is enter the information from your 1098 you received from the bank by doing the following:

  1. Click Federal Taxes
  2. Deductions and Credits
  3. Scroll down to Your Home and Click Show More
  4. Click Start next to Mortgage Interest, Refinance and Insurance (Form 1098)

However, if you are NOT on the loan and only your spouse is, you will not be able to take the deduction unless you are married filing jointly as the IRS requires you to be legally liable for the loan in order to take an interest deduction.
