Had a car accident, medical expenses have surpassed $70,000 but are third party pay. Meaning all bills went to lawyers office to be paid upon settlement. Do I claim these

No, you would not claim these as medical expenses unless you had paid them yourself during the tax year.  Any expenses reimbursed to you or paid by another party would not be deductible.
