I have 2 children amd live with my mother i pay her rent 400 monthly she made 20000 from unemployment  this year2020 i made 12000 this year from unemployment since my mother made more than me is she the HOH and does she get to claim my children or can i claim my children or can i claim HOH and claim my own children

    OK ... you as the parent has the right to claim your children first however since mom can also claim your children then you can defer to her which allows her to also claim HOH.  Now you could each claim one child but only mom can claim HOH ... at $12K you don't need it at all.  

     

    BEFORE either of you file you really need to  compute both returns  putting both kids on your return, both on her return and one each.   See what combination works the best overall so you get the most money legally possible. 

     

    *** for 2020 there is a new wrinkle to consider ... who got the advance stimulus for the kids?   If you did and grandma  claims the kids on her 2020 return then SHE will also get the credit and it is legal.
