Question

I am an independent contractor. I spend my family's medical expenses from my HSA account. Can I claim them as expenses and deduct from my business income?

no. your family's medical expenses are not, and never are, a business expense. besides, you're paying them out of an HSA for which you got a tax deduction (or didn't pay taxes on any portion contributed by your ex-employer so they don't qualify for a Schedule A medical expense either.  the IRS looks extremely unkindly towards those taxpayers that double-dip. if you are self-employed and have a qualifying High Deductible Health Plan, you can continue to contribute to an HSA subject to the rules and limitations.
