I am Married but my name is not on the loan, can I claim the paid property tax?

I am Claiming head of house hold can I claim the property tax paid for the home although the loan is in my wife's name?

To claim property tax, you must be the owner of the home against whom the tax is assessed, and you must be the person who actually pays the tax.  Marriage implies co-ownership under federal tax law, so if your spouse owns the home, you are considered to co-own it even if your name is not on the mortgage or the deed.

 

However, you generally can't file HOH unless you have been separated more than 6 months.  So it's unclear to me that you would be paying the mortgage for a house your wife owns but you don't live together?  This might require clarification.
