If I do not have an HSA or HD Health plan, but have a section 125 FSA, should I have a W in box 12 of my W-2?

I have never had a W in box 12 before, and my employer says that they use new software, so this must be a change due to that.

No, you should only have a W in box 12 if you have a Health Savings Account (HSA) with contributions made through your payroll system.  You should request a corrected W-2 because this will affect your tax return.

 

Section 125 FSA (flexible spending account) are funded with pre-tax money and not reported on your tax return.  They may be shown on your W-2 for your information, but it would be in Box 14, not box 12.
