Question

If my daughters mother claims our daughter on her taxes to get the money, but I pay for half of daycare etc. do I then qualify for any kind refund or tax money back?

Only one parent can claim the dependent care credit.  If your daughter's mother claimed the credit, you would not also be able to claim the credit.

However, if she did not claim the credit and you are the custodial parent, not claiming your daughter as a dependent, then you may be able to claim the credit.

For tax purposes, the custodial parent is usually the parent the child lives with the most nights. If the child lived with each parent for an equal number of nights, the custodial parent is the parent with the higher adjusted gross income (AGI).
