Question

married filing separately and claimed spouse on accident; stimulus check?

My husband and I filed our 2019 tax returns as married filing separately.  My husbands e-file was accepted but mine was declined; I accidently did not mark the box that someone else could claim me so my return was rejected because I was claimed on my husbands return.  We amended his return and mailed it in; it was received on 3/10/20 but has not completed processing (which can take up to 16 weeks).  My question is this.  My husband received the stimulus check based off his 2019 tax return but I can't file my taxes until his is corrected.  Am I just out the $1200 for my stimulus check or are they processing those later in the year as well?  I read I could mail my paper 2019 tax forms but it looks like the IRS is not processing paper claims at this time and they are not taking phone calls at this time. Any guidance would be appreciated.  Thanks!

You cannot be claimed as a dependent by your spouse.  However, it sounds like you have already worked to correct the tax return as necessary.

If your tax return was rejected for e-file due to duplicate SSN, you will need to mail your return for processing even though the processing is currently delayed.

It is not known if, upon processing, an advance payment will be sent. Any taxpayer whose advance payment received is less than the full payment for which he or she is entitled, will be eligible to claim the difference as a credit on the 2020 tax return filed in 2021.
