Mortgage Interest on my deceased fathers estate

My father died in 2019 and I pay his mortgage while his girlfriend lives in the house.  The house title is not in my name, but the 2021 Mortgage Interest Statement is made to:  Estate of (my father's name)  C/O (my name) with my home address.  

1. Can I claim the Mortgage Interest in box 1 ?

2.  How do I list this property in my taxes?  Rental, other, What?

    From your description, the answer is no deduction.

     

    Look at the rules in Publication 936 (2021), Home Mortgage Interest Deduction - IRS which states:

    You can’t deduct home mortgage interest unless the following conditions are met. 

    • You file Form 1040 or 1040-SR and itemize deductions on Schedule A (Form 1040). 
    • The mortgage is a secured debt on a qualified home in which you have an ownership interest.
