My boyfriend file for our kid as his dependent. but I pay all the daycare expenses and have a letter from the daycare with how much I paid. Can I put this in my taxes?

No. Since you weren't married and didn't live apart for the last six months of the year, only one of you will be able to file and claim all related credits for the child. For more information about the child and dependent care credit, please view the Turbo Tax FAQ below.

If you were separated for the last six months of the year, both of you could claim some benefits for this child. In this case, you would qualify for the special rule for divorced and separated parents. For more information about this rule, please view pages 9-10 of IRS Publication 504.
