My child is 100% disabled and my taxes were filed wrong for years what can I do

My son is 100% disabled has been since 2013. I have been getting my taxes done by h&r block for many years during the entire time they have not filed my son as disabled in which I told them to every time he is now 20 years old is there anything I could do about all the lost credit

Not sure what lost credits you are referring to.   There is no federal credit for having a disabled child, except if the child is older than 12 and you had to pay someone to care for them while you worked you can still get the child and dependent care credit.   And you can still claim the child as a qualifying child dependent past the age of 19 even if they are not a full-time student.

 

Your state tax laws might be different.

You could have lost the Earned Income Credit if your income is low enough to qualify for it.  You can go back and amend the 2018, 2019 & 2020 returns.   Go back to Block and demand the correct the returns for free... talk to a manager.

@Critter-3 User says the child is now 20---so if she qualifed for EIC should have been getting it all along by claiming the child as a dependent.  But----yes----go back to H & R Block if Block missed something and have Block amend the returns.

Go back to HR Block and ask if your son qualifies for any credit.  If he does, then HR Block can file an amend for the years that are still eligible to be amended.

Here's what could have been missed:

  • Child and dependent care credit after your child turned 13, if you paid for "daycare" for your child so that you (and your spouse if married) could work, because your child was unable to care for themself.
  • Earned income credit for any year when your child was 19 or older on December 31, if you are low enough income to claim EIC.
  • If your child earned more than $4300 in any year that they were 19 or older on December 31, you might have lost head of household status, if you are unmarried and would normally qualify for HOH.

 

That's really all.  The tax benefits of caring for a child who is disabled are not very significant, it's more important now that the child is an adult. 

 

If you think you improperly lost those specific benefits, HRB should prepare amended returns for you per their guarantee.
