My ex is getting the exemption for my daughter this year, he can't claim the EIC. How do I claim the earned income on the form without taking her as an exemption?

You will need to do the following: 

If you are the custodial parent, you need to make sure you do the following:

  1. Enter your dependents information as it you were claiming all of the dependent benefits alone.
  2. Enter that you lived with the child for the whole year.
  3. Continue to the question that asks if you have a custody agreement and answer yes.
  4. On the next screen, answer yes the other parent will claim your child as a dependent.

This will allow him to claim the dependent and the child tax credit.
