Hello,

I need to file my tax return for 2024 and would appreciate some guidance. I entered the United States in September 2023 on a J1 visa, and then I changed my status to H1B, which became valid on August 16, 2024. I was on J1 from January 2024 to August 15, 2024. I filed my 2023 tax return using Glacier which is for non-resident.

Could you please help me understand how I should file my tax return for 2024? Am I considered a resident for tax purposes now that I hold an H1B visa?

I’m unsure of the process and would really appreciate your assistance.

    No. You would file as a 1040 NR for 2024 because you haven't satisfied the substantial presence test  in 2024. The look back period for the test started on Aug 16 thus 183 days have not elapsed since that time. You will qualify to file as a resident alien in 2025 if you stay in the US.

    What about my spouse, who doesn’t have an SSN yet and isn’t working, given the same situation as mine?

    Since your spouse isn't working and also isn't yet considered a resident for tax purposes, she is not obligated to file a US tax return at this time (assuming she has no other income that is from US sources.)
