Tax Return for 2019 (W2 and 1042-S)

I have questions about filing the tax return for 2019.

 

I worked in the United States with an E-2 visa for 9 months in 2019 in the US.

Prior to going back to my country, I had withdrawn my 401K (30% of the penalty were deducted).

 

Since it is getting closer to April 15, I should finish my tax return; however, I was only given the W-2 form, but not a 1042-S. In this case, can I file W-2 form first and file the 1042-S afterward? If not, what step should I follow? I am very confused with all of these complicated processes. 

 

Please guide me through this! I appreciate with your help in advance!

You should wait until you receive both forms.  You should contact your employer about the missing 1042-S form as employers have until January 31st to send out the forms (unless they are on a secure website).

 

You can always file an extension before April 15th which will extend your return until October 15, 2020.  This is an extension to file not an extension to pay as interest and penalties accrue from April 15th.  You can file an extension through TurboTax .  I am not sure if the extension form in TurboTax has been finalized.at this point. 

 

If you moved back to your home country around September 2019, you are considered a dual status taxpayer.  Your residency termination date is considered December 31, 2019.  You should file a full year resident return and claim your worldwide income for calendar year 2019.  You can claim the foreign tax credit for any wages you earned in your home country in 2019 . to help offset double taxation.
