Why is the California child and dependent care expenses credit no longer refundable?

Did something change recently? It says the child and dependent care tax credit is Now Nonrefundable, saying I may not get the full benefit of the amount I qualify for. I tried researching and everything I have read says its Fully Refundable. what's going on?

For the 2021 return ...  the feds yes but CA NO ... read the instructions here ... clearly says NONREFUNDABLE :
