Will I still receive my return if I am off child support, but I am still paying back child support every month still?

I currently regained full custody of my child. I was on child support, but the judge took me off seeing as his mother did not want him. They granted me full custody and stopped my child support payments. I do however make small payments on back child support every month out of my checks. Will I still receive my full refund?

No, the government will most likely take the entire refund (or portion of the refund if you owe less than the refund) to cover your back child support.  They will continue to do so until entire debt is paid off. And of course once that is done, you will be receiving your full refunds, since there will be no past due debt.

I know this is an old conversation but wanted to share a thought just in case anyone else reads this who might be in a similar situation. If you go from being the noncustodial parent to custodial parent, I understand the relief of a lifted child support order feels like a victory, but it isn't enough. It's an absolute necessity to seek court ordered child support no matter what the financial situation is. Its the only way to keep certain types of parents accountable to their children.

i have a 5 year old son. I was 16 his mom was 19 she left me got with another guy at the time I moved up state to my moms to get a better job career not even knowing he was mine. She then filed for dna almost 3 years later so I’m paying retro arrears to the state I’m on a payment plan paying it every paycheck. No longer have regular child support due to her husband that has raised my son since born has now adopted him. So will my taxes still be taken for the retro arrears amount?
