If my mother claims my undergraduate 1098T form and I also include it for scholarship purposes. In addition to my 1098T for undergraduate, I also have a 1098T form for my graduate school. Can I claim this form since I am paying for graduate school or no since 1 or more credit is already claimed?

    It depends.

In order for your mother to claim the undergraduate tuition costs, you would have to be considered a dependent on her return.

To be qualified as a dependent, you should:

    • Be under age 24 if a full-time student
    • Living with your mom for more than half of the year (except for periods when you are away at school)
    • And you didn't provide more than half of your support

If all of the above apply, then she can claim you as a dependent and she would be able to take both 1098-T Forms to claim the education credit.

Only one type of education credit is allowed per year per qualifying student.

If you filed using your graduate 1098-T form, and your mom filed using your 1098-T undergraduate tuition, you would be claiming an additional credit you are not entitled to by law.
